Outcome of a Disciplinary Sub-Committee Hearing Held on 27 September 2017

Disciplinary Sub-Committee (DSC) Consideration of an Incident which occurred near the 18th tee on Saturday 2 September 2017

The meeting was held in the Bat Cave on 27 September 2017 and convened at 6:10 pm

It was agreed that:

·         The basic facts were not in dispute;

          o   A member had completed the playing of the 18th hole

           o   He then hit a ball in the direction of the clubhouse

           o   The ball hit the roof of the clubhouse and landed on the practice putting green.

·         As the incident occurred before the introduction of the new Code of Conduct, the current Code of Conduct applied.

·         There was no doubt in the DSC members’ minds that the member’s behaviour did not meet the

           ‘highest standard of behavior and etiquette’ as laid down in 7.1 (b) of the current Code of

            Conduct

·         a penalty therefore needed to be applied

·         In determining the penalty, the following factors were taken into account:

          o   The member, in the meeting, had finally accepted that his conduct was in breach.

          o   This was the first report of ‘equipment abuse’ made against this member to the committee   

               (there was discussion about other, non-reported incidents. It was, however, agreed that the

                DSC could only deal with reported events).

         o   The question of a suspended penalty was discussed, but this was not available under the

               current Code of Conduct.

 

·         It was therefore agreed to:

          o   Issue the member with a formal warning.

           o   Remind the member that any future breach will be heard under the new By-Laws/Code of

                Conduct and that, as it would be a second incident, the maximum penalty available to the 

                future DSC would be double the ‘Penalty Guide’.

The meeting ended at 6:45 pm
