Disciplinary action reinstated

An update on recent disciplinary matters.

After extensive consideration and negotiation, and in the spirit of fairness and natural justice, the YGC Committee entered into a formal agreement with a Member. As part of that agreement, the previously announced expulsion was wholly suspended upon both the Member and the Club agreeing to a number of conditions and binding undertakings.

In the interests of transparency, those obligations are detailed below.

Member obligations

The Member hereby acknowledges and agrees that upon execution of this Agreement he will:

(a)     Immediately cease to publicly promote the Member Proposal or any variation of same;

(b)     Immediately cease to correspond or communicate with the Committee or any member of the Committee regarding the Member Proposal or any variation of same;

(c)     Not solicit other members of the Club to publicly promote the Member Proposal or any variation of same;

(d)     Not initiate discussions with other members of the Club with respect to the Member Proposal or any variation of same whilst on Yarrambat Golf Club premises; and

(e)     Not initiate discussions with any member of Course management or staff with respect to the Member Proposal or any variation of same.

Club obligations

The Club hereby acknowledges and agrees that upon execution of this Agreement it will:

(a)          Wholly suspend the Member’s expulsion from the Club;

(b)          Wholly reinstate the Member’s membership rights with no loss of benefits;

(c)          Cancel the Member’s appeal; and

(d)          Undertake to:

(i)         Review grade separations on a day to day or competition to competition basis as permitted under the Club By-Laws; and

(ii)        By 1 March 2020, appoint a subcommittee to holistically review the Club’s direction and activities, to ensure the longevity and success of the Club, with consideration of member demographics. The sub-committee may, at its sole discretion, invite submissions and review any information as may be deemed relevant by the subcommittee with the intention of having the subcommittee report its findings and recommendations to the Club Committee by 30 June 2020.  

Member breach

1.  In the event that the Member breaches his obligations the Club may reinstate the sanction arising from disciplinary action in accordance with Division 2 of the Club Rules on the basis that such breach, if sustained, is agreed to be prejudicial to the interests of the Club.

Result 

On Wednesday 25th March 2020, the YGC Committee met to discuss a series of emails and conversations on the part of the Member. These were assessed as breaching the Agreement into which he had voluntarily entered into during December 2019.

Despite being advised to discontinue the course of action, the Member continued to promulgate his proposal.  These actions constituted a clear breach of the Agreement and, as a result, the Member has been immediately expelled from the Yarrambat Golf Club.

This member’s permissions to participate in any sanctioned YGC events, either competition or social, have been revoked.
